By completing the registration process, you are indicating your agreement to be bound by all of the terms and conditions of the folloging terms of use.

§ 1 Description of Service

The Guestbook24.eu service (subsequently called "Service") is owned and operated by WebMart Online Tools Limited (subsequently called "WOT"). WOT offers you (subsequently called "User") the possibilty to integrate a virtual guestbook into your site. All data entered into your guestbook will be stored in a database server maintained by WOT. The guestbook pages are dynamically generated out of this database.

§ 2 Rules, Regulations

Users of this Service are responsible for everything contained on their own web site and their guestbook. WOT does not verify, endorse, or otherwise vouch for the contents of any web site using this Service. Users can be held legally accountable for the contents of guestbook entries if the guestbook includes for example: material protected by copyright, trademark, patent, or trade secret law.

User agrees not to transmit through the Service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature. User further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation.

User shall not interfere with another User's use and enjoyment of the Service. User agrees not to resell the Service without the prior written consent of WOT.

User also agrees not to change the guestbook pages after they have been generated and sent by our server. Especially banner images and links to our sponsors are part of the Service and shall not be removed or modified or hidden.

WOT is in no way responsible for the content of any guestbook entry or User's homepage. The opinions and views expressed do not necessarily reflect those of WOT or WOT sponsors.

WOT may, at its sole discretion, immediatley terminate Service should User's conduct fail to conform with these terms and conditions. This includes the right to remove any entry or complete guestbook from its database if it is unacceptable for any reason, without prior notice, including but not limited to violations of these rules and regulations.

WOT may also deny or terminate membership to Users who abuse the Service (including but not limited to SPAM) or repeat offenders of this agreement.

§ 3 Modification to Terms of Service

WOT may change the terms and conditions of this agreement at any time. Upon any change in the terms and conditions, WOT will notify the User by posting the changes on her/his news page. If the User agrees to be bound by the changes, s/he must again click the "I Accept" button that will follow the posted changes. If the User does not click the "I Accept" button, s/he terminates her/his use of the Service at that time.

The continued use of the Service constitutes an affirmative acknowledgment of the agreement and its modifications and an agreement to abide and be bound by the Terms of Service and its modifications.

§ 4 Modifications to Service

WOT reserves the right to modify or discontinue the Service with or without notice to the User. WOT shall not be liable to the User or any third party should WOT exercise its right to modify or discontinue the Service.

The number of entries for a guestbook is currently not limited. Although WOT currently has no plans on introducing a limitation this may be subject to change in the future.

§ 5 Privacy Policy

It is WOT's policy to respect the privacy of its Users. Therefore, in addition to the privacy of registration data, WOT will not monitor, edit, or disclose the contents of a User's guestbook unless required to do so by law or in the good faith belief that such action is necessary to: (1) conform to the edicts of the law or comply with legal process served on WOT; (2) protect and defend the rights or property of WOT; or (3) act under exigent circumstances to protect the personal safety of its Users or the public.

User acknowledges and agrees that WOT neither endorses the contents of any User communications nor assumes responsibility for any threatening, libelous, obscene, harassing or offensive material contained therein, any infringement of third party intellectual property rights arising therefrom or any crime facilitated thereby.

§ 6 Password and Security

The User is responsible for maintaining the confidentiality of his/her password and account, and is fully responsible for all activities that occur under her/his password or account. The User agrees to immediately notify WOT of any unauthorized use of her/his password or account or any other breach of security. WOT cannot and will not be liable for any loss or damage arising from User's failure to comply with this Term.

§ 7 Disclaimer of Warranty

USER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT USER'S SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

WOT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

WOT MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES WOT MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED.

§ 8 Limitation of Liability

WOT SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASE OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF USER'S TRANSMISSIONS OR DATA, INCLUDING, BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF WOT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

§ 9 Indemnification

User agrees to indemnify and hold WOT, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of User's use of the Service, the violation of this Terms of Service by User, or the infringement by User, or other user of the Service using User's computer, of any intellectual property or other right of any person or entity.
